Tigon Studios Inc., which licensed Vin Diesel’s voice and name for use in Midway Games Inc.’s (MWYGQ) Wheelman videogame, is objecting to the company’s upcoming auction, saying Midway hasn’t made its plans for the sale clear and already owes more than $200,000 under the contract.
Tigon, a production company founded by the action star in 2002, wants to make sure its rights are preserved if its deal with Midway is auctioned off as part of the videogame maker’s upcoming sale. But it said it can’t even tell if the two agreements it entered into with Midway are to be placed on the auction block on June 29 alongside Midway’s others assets.
There is a “lack of clarity in the sale motion as to how it proposes to treat the licenses,” Tigon said in court papers filed Thursday.
Tigon gave Midway permission to use Vin Diesel’s “name, voice, signature” and “computer-generated likeness” in its Wheelman videogame, in exchange for an undisclosed fee. But Tigon retained the exclusive right to “assign, transfer and sell to any studio the right to produce a theatrical motion picture and television production based on Wheelman,” and it wants to make sure it stays that way, no matter the outcome of the sale.
“Tigon expressly reserved the right, among other things, to license the movie and television production rights to Wheelman,” it said.
Tigon is also requesting permission to keep the details of both contracts – the one governing the use of Vin Diesel’s voice and name, and the one giving Tigon the right to license the movie and TV rights – secret by filing them under seal. The company cited a confidentiality clause that it claims requires it to keep the information under wraps.
